Terms of Service

1. General

These Terms of Service govern the relationship between “webdesiz” (the “Service”), operated by Birim Ajans Yazılım Limited Şirketi, and you (the “User”). By registering for the Service, you are deemed to have accepted these terms.

2. Description of the Service

webdesiz is a SaaS application that provides its users with a management interface for their Meta Platforms (Facebook + Instagram) ad accounts. The features we provide include:

• Connecting an ad account (Facebook Login for Business or System User Token)
• Creating and pausing campaigns, and budget management
• Performance reporting and dashboards
• Rule-based automation
• Ad copy and image generation in Turkish with OpenAI

3. Account and Responsibility

• Account security (password, 2FA) is your responsibility
• Access tokens to your Meta account are obtained with your authorization and are used only in a controlled manner
• Use of the Service by users under the age of 18 is prohibited
• You are responsible for the accuracy of the information you provide and for the validity of legal information such as your tax number

4. Prohibited Use

It is prohibited to use the Service for the following purposes:

• Running ads that do not comply with Meta Platforms' Advertising Policies
• Publishing misleading, unlawful, or copyright-infringing content
• Gaining unauthorized access to another party's ad account
• Scraping, automation abuse, or DDoS attempts targeting our system
• Use outside of lawful business processes (spam, counterfeit products, etc.)

In the event of a violation, your account may be suspended without notice, and your data will be deleted except where legal obligations require otherwise.

5. Subscription and Billing

• A 14-day free trial begins without requiring a credit card
• Once you move to a paid plan, it renews automatically each month. Charges continue unless you cancel
• Cancellation: “Cancel subscription” from your account settings — access continues until the end of the current period
• Refund policy: for annual payments, a full refund within the first 14 days. No pro-rata refund is issued thereafter
• 3D Secure is required for payments processed through Stripe

6. Service Level (SLA)

• 99% uptime target (excluding scheduled maintenance)
• Data updates may be delayed due to Meta API load — this is beyond our responsibility
• Maintenance windows are announced 24 hours in advance

7. Intellectual Property

• The application code, brand, and logo belong to us
• The copy and images you generate with AI belong to you — you may use them in your ads in any way you wish
• You are responsible for ensuring that the generated content does not infringe third-party copyrights

8. Limitation of Liability

The Service is provided “as is”. We are not liable for any material or non-material damages, loss of profit, or losses on advertising investment. Our liability is limited to the subscription fee you paid in the last 12 months.

We are not responsible for situations such as Meta Platform's API changes, account closures, or ad rejections.

9. Third-Party Services

The use of third-party services such as Meta, OpenAI, Stripe, and Resend is subject to these providers' own terms. We are not responsible for outages or policy changes by these providers.

10. Changes to the Terms

We may update these terms from time to time. Material changes will be notified by email. Continuing to use the Service after an update means that you accept the new terms.

11. Governing Law and Jurisdiction

This agreement is governed by the laws of the Republic of Turkey. In the event of a dispute, the Istanbul Courts and Enforcement Offices have jurisdiction.
